1. ELD Factory and these terms
ELD Factory is a service of General Software Company LLC ("General," "we," "us," or "our"). These terms govern the ELD Factory website, account, hosted administration tools, and related platform services. "You" means the individual using the service and, when that individual acts with authority for a business, that business.
Use the service only if you can accept these terms and are authorized to perform the actions you take. If you act for an organization, you must have authority to bind it to the applicable agreement. A separately signed order or services agreement controls the commercial matters it specifically addresses if it conflicts with these terms. Our Privacy Policy explains how information is handled.
2. What the platform provides
ELD Factory manufactures electronic logging device hardware and provides hosted software for trucking companies administering their own ELD operations. Customers administer settings and authorized records within their licensed hosted workspaces and supported permissions. This is a hosted-service access license, not a sale of software or source code. The per-asset service and hardware lease are described below. Registration assistance, integrations, and commissioned applications depend on the agreed scope.
The currently available administration and manual-record tools are not a qualified operational ELD. Automatic vehicle capture in the ELD Factory platform, complete hours-of-service functionality, and store releases remain unfinished. Do not use a preview, demonstration, or unfinished configuration as your required operational ELD. Sample customer brands and demonstration workspaces illustrate the platform; they do not establish a customer's registration or operational readiness.
A written scope must identify the functionality, supported devices, integrations, delivery milestones, and responsibilities being purchased. A proposed feature, an estimate, or a marketing illustration does not establish that a feature is available. Store availability and regulatory readiness must be confirmed for the complete offering before operational use.
3. Customer operations, driver support, and General's technical role
You administer your licensed workspace settings, authorized records, personnel access, and operations. You are fully responsible for the accuracy of information you supply and for your obligations as a motor carrier and, where applicable, an ELD provider. Licensing our software does not transfer those responsibilities to General.
You must provide and maintain your own support staff for your drivers. Your staff handles driver questions, logbook issues, and day-to-day operational assistance. General does not make ELD or logbook edits and does not provide driver or logbook support. Your authorized personnel and drivers must use the supported record workflows within their permissions.
General is responsible for the availability and technical operation of the hosted service, including maintaining the platform and addressing platform technical faults, subject to the service limitations below. This technical role does not transfer your operational or regulatory responsibilities to General. The separate hardware warranty and replacement commitments remain included.
FMCSA registration is based on provider registration and self-certification; it is not an agency guarantee or endorsement of a product. We may assist with preparation, but cannot guarantee a listing, a particular decision, or continued eligibility. A customer must evaluate and satisfy the requirements that apply to its actual hardware, software, users, and operations.
For a motor carrier required to use an ELD, 49 CFR 395.22(a)
states:
A motor carrier required to use an ELD must use only an ELD
that is listed on the Federal Motor Carrier Safety
Administration's registered ELDs list, accessible through the
Agency's website, www.fmcsa.dot.gov/devices.
See
49 CFR 395.22. An ELD Factory account or company name does not establish that
listing.
Drivers and carriers remain responsible for truthful records, required review and certification, safe operation, and required malfunction and inspection procedures. The software does not authorize falsification, coercion, unsafe driving, or bypassing recordkeeping requirements. Never interact with a device in a way that interferes with safe driving.
4. Accounts and authorized access
ELD Factory accounts are for people aged 18 or older acting for a lawful professional purpose. This is our account-eligibility policy, not a statement of the minimum legal age or qualifications for every kind of commercial driving. See Age and Consent.
Keep account information accurate and protect your email account, sign-in codes, sessions, and devices. Use your own identity. Do not share another person's sign-in code or impersonate a driver. Report suspected unauthorized access to accounts@generaleld.com.
Signing in proves control of an account; it does not grant access to every company, driver, vehicle, document, or record. Organization and resource permissions apply separately. Administrators must grant access only to authorized people, keep assignments current, and remove access when it is no longer appropriate.
5. Software license and customer information
Subject to the applicable agreement, payment terms, authorized scope, and app availability described below, General grants you a limited, nonexclusive license to access its hosted ELD Factory service and use included applications for their intended business purpose. General continues to host and maintain the platform. You receive access to the service, not ownership of the software.
No software ownership or independent deployment rights are included. This license does not transfer ownership of the platform, applications, source code, or other General intellectual property. It does not include delivery of source code or a right to self-host, copy for independent deployment, sublicense, resell, or independently distribute the software. Branding a workspace, using your domain, or administering records does not change that allocation of rights. Applicable non-waivable legal rights and any third-party software licenses remain unaffected.
Custom applications remain licensed. A custom-app fee pays for the development, branding, and submission services stated in the accepted order. It does not purchase source code, software ownership, self-hosting rights, or independent distribution rights. Any expressly authorized app-store distribution is limited to the agreed application and store process; it does not authorize distributing or operating the underlying platform independently. A custom-app order does not guarantee store approval or regulatory qualification.
Your data and brand remain yours. As between you and General, you retain the rights you have in your customer records, submitted materials, company name, logos, trademarks, and domain names. You authorize us to process the records and use those marks only as needed to provide, brand, secure, maintain, and support the agreed service, fulfill authorized instructions, and meet applicable legal obligations. You are responsible for having the necessary rights and authority to supply personal information, documents, organization records, and brand materials.
Record changes must use the supported workflow. Where the service preserves originals, annotations, decisions, or certification history, a correction is not a promise that the earlier record will disappear. Access and deletion requests are handled as described in Account and Data Deletion, including applicable record-retention duties.
6. Required customer-controlled service domain
Every customer must connect its own domain or subdomain for operational access to its hosted workspace. You must control that address, maintain its registration and required DNS settings, and complete the domain-control verification required for onboarding. A branded workspace is not activated for operational use merely because a domain name has been entered or requested.
General hosts the software behind the verified customer address. Connecting a domain does not give you software ownership, source-code access, a self-hosting license, or a right to operate an independent copy. The agreed onboarding scope defines the supported setup and any configuration assistance. Domain connection does not by itself establish regulatory qualification or make an unfinished service operational.
The ELD Factory main website account area is for account and billing matters only. It is not a shared operational ELD portal for customer fleets. Operational users must use the authorized customer workspace address and their assigned permissions. The public Account & Billing page currently provides contact and invoice-help instructions; it does not provide an online billing sign-in or accept payments.
7. Orders, fees, and cancellation
Creating an account or browsing a demonstration does not by itself purchase a paid plan. The per-asset service and hardware lease terms below describe the included offering. Other plan fees, asset counts, setup work, payment dates, billing periods, taxes, cancellation arrangements, and any refund rights are established in the accepted order or other written commercial agreement. Public pricing describes an offering; confirm the scope and charges before purchasing.
Setup estimates depend on the agreed scope, product readiness, information supplied by the customer, third-party services, and any registration or store-review process. They are not guaranteed completion or approval dates. Custom applications and integrations are included only when expressly agreed. A customer-controlled service domain is required under the domain section above; configuration assistance and any related charges must be specified in the accepted order.
Contact accounts@generaleld.com about an order, cancellation, or billing question. Account deletion and commercial cancellation are different requests; tell us if you want both reviewed. Statutory rights that cannot be waived remain available.
8. Per-asset service, hardware lease, warranty, and returns
Setup costs $100 per asset as a one-time charge. The $15 monthly charge per asset includes the ELD Factory hardware lease, ELD service, hosted backend, and use of ELD Factory's shared phone-based iOS and Android apps, subject to the platform and app availability described in these terms. This is the monthly per-asset charge shown in ELD Factory plan pricing. The one-time per-asset setup is separate from any platform plan setup or custom-app fee identified in your accepted order. The setup and lease payments do not transfer ownership of the device; leased hardware remains General's property.
Warranty and technology replacements. The leased hardware remains under warranty throughout your lease. If anything goes wrong with your leased device, General will provide a replacement. Your lease also includes replacement hardware as General updates the product and introduces improved technology.
Replacement shipping. General ships replacement devices using UPS 2nd Day Air or FedEx 2Day to any location within the lower 48 contiguous United States. These are two-business-day carrier services; the service designation describes shipment transit, not a promise of arrival within 48 hours of your replacement request.
Return after cancellation. You must return all leased hardware to General within 90 calendar days after your service cancellation takes effect. This is a return period following cancellation, not a requirement to cancel within the first 90 days of service. The return obligation continues after cancellation.
Contact accounts@generaleld.com for replacement assistance or return instructions. Identify your account and the devices involved so we can coordinate the replacement or return.
9. Apps, devices, and other providers
Compatibility is limited to supported and qualified configurations. Connecting a company or enabling an integration does not establish that every third-party application, device, or regulatory function is supported. Third-party services may require their own agreement, fees, permissions, and privacy notice. An integration must be authorized by the appropriate account or organization; possession of an identifier alone does not authorize access.
The per-asset service includes use of ELD Factory's shared phone-based iOS and Android apps. These apps are currently previews and have not been released in the app stores; inclusion in the offering does not represent that a store download or a qualified operational ELD app is available today. If an iOS application is later distributed through Apple's App Store without a separately designated custom license, Apple's Standard End User License Agreement applies to that application. These hosted-service terms are separate and do not replace Apple's license or store terms. Other distribution channels may apply their own terms.
A custom-app order may cover development and submission assistance. Apple, Google, and any applicable regulator make their own decisions. We do not guarantee their approval, timing, continued availability, or permission to use an unqualified configuration.
10. Acceptable use
Use ELD Factory lawfully and within your authorized role. Do not access another organization without permission, share credentials to evade access controls, introduce malicious software, interfere with service availability, misrepresent identity or registration status, or use the service to falsify records or conceal required history. Do not copy, resell, or redistribute software beyond the rights in your agreement, except where applicable law provides a non-waivable right.
We may restrict access when reasonably necessary to address unauthorized activity, security threats, unlawful use, or a material breach. Where appropriate and legally permitted, we will explain the reason and the steps needed to resolve it. Security restrictions do not remove a carrier's recordkeeping obligations or automatically erase records.
11. Service limitations and legal rights
General's responsibility for hosted-service availability and technical operation applies to the purchased service. The service also depends on networks, devices, hosting providers, and other systems. We do not promise uninterrupted or error-free operation. Preview and demonstration functionality may change. Our express hardware lease warranty and replacement commitments are stated above. Any additional service level, warranty, acceptance process, or support commitment must be stated in the applicable written agreement.
The limitations in this section do not remove General's stated technical service responsibilities or reduce our express hardware lease warranty or replacement obligations. To the extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement that are not expressly provided in these terms or an applicable agreement. To that same extent, General is not liable for indirect or consequential losses arising from use of the service. These provisions do not exclude or limit liability for fraud, intentional misconduct, or any obligation or right that applicable law does not permit us to exclude or limit.
Nothing here substitutes for a customer's evaluation of the complete ELD system or permits a party to avoid a non-waivable legal duty. If a provision cannot lawfully apply, the remaining provisions continue to apply to the extent permitted.
12. Changes and questions
We may update these terms as the service develops or requirements change. The effective date and published policy version identify this version of the terms. For material changes affecting an existing account or agreement, we will provide notice appropriate to the change and obtain further agreement where required. A later website update does not silently rewrite a separately signed order.
Questions, notices, technical concerns, and requests concerning these terms may be sent to General Software Company LLC at accounts@generaleld.com. Identify the relevant account or organization and the nature of the request; do not include a password, sign-in code, or unnecessary sensitive documents.
